herapy — Voice & Text Wellness Support

1. Acceptance

By downloading, installing, accessing, or using herapy (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy, incorporated by reference.

If you do not agree, do not use the Service.

These Terms are a legally binding agreement between you and ICI Tech Teknoloji A.Ş. ("Company", "we", "us", "our"), registered in Turkey.

2. Definitions

Term Meaning
Service herapy iOS app, Android app, website at https://herapy.app/, and all features
User / you Any person who accesses or uses the Service
Account An optional registered user profile created with an email address and password
Guest A user who uses the Service without creating an account
Voice Session A session where you speak to herapy using your device's microphone
Text Session A session where you communicate with herapy via typed text
Content Mood check-ins, text entries, session notes, and other data you create in the Service
Company Content All software, designs, audio assets, text, and other material provided by us

3. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Be capable of forming a legally binding contract
  • Not be prohibited from using the Service under applicable law

By using the Service, you represent that you meet these requirements. If we learn a user is under 18, we will terminate their account and delete their data promptly.

4. Account Registration

An account is not required. You may use herapy as a guest without providing any personal information. Guest data is stored locally on your device only.

If you choose to create an account, you agree to:

  • Provide accurate, current, and complete information
  • Keep your credentials confidential
  • Notify us at app@icitech.com.tr of suspected unauthorized access
  • Maintain only one account

Creating multiple accounts to abuse any feature is prohibited.

5. The Service — What herapy Is and Is Not

What herapy IS

herapy is a personal wellness support companion designed to:

  • Provide a safe, private space to speak or write about everyday stress, anxiety, and overwhelm
  • Guide you through daily mood check-ins and emotional self-reflection
  • Generate weekly insights based on your own entries
  • Offer voice and text sessions at any time of day or night
  • Help you build awareness of your emotional patterns over time

What herapy IS NOT

herapy is not:

  • A therapy service or substitute for licensed psychotherapy or counselling
  • A clinical diagnosis tool or medical device
  • A mental health crisis service or emergency helpline
  • A replacement for professional psychiatric or psychological care
  • A guaranteed treatment for any mental health condition
  • A monitored service (no human reviews your sessions in real time)

If you are in mental health crisis, experiencing thoughts of self-harm or suicide, or facing a psychiatric emergency, please contact your local emergency services or a crisis helpline immediately.

6. Mental Health and Safety Disclaimer

Please read this section carefully.

Not clinical care

herapy does not provide clinical assessment, diagnosis, or treatment. The voice sessions, text coaching, mood tracking, and weekly insights in herapy are tools for personal reflection and emotional awareness — not professional clinical interventions.

Always seek the advice of a qualified mental health professional for any clinical concern, diagnosis, or treatment decision. Do not delay seeking professional help because of something you experienced in herapy.

Crisis situations

herapy is not a crisis service. If you or someone you know is in immediate danger or mental health crisis:

  • Contact your local emergency services (e.g. 112, 999, or 911)
  • Contact a crisis helpline in your country
  • Go to your nearest emergency department

herapy does not monitor sessions in real time and cannot contact emergency services on your behalf.

Emotional content

Talking or writing about difficult emotions can sometimes be uncomfortable or distressing. You are in control of every session. You can stop, pause, or exit at any time. If you feel distressed during a session, please close the app and seek appropriate support.

7. Voice Feature — How It Works

The voice feature is central to herapy's design. Understanding exactly how it works is important:

  • Your voice is captured by your device's microphone during a voice session.
  • All voice processing occurs entirely on your device — your audio is never transmitted to our servers.
  • We receive only session timestamps and duration, not audio content or transcripts.
  • Your spoken words are never stored, analyzed, or accessible by us or any third party.
  • Voice sessions are not recorded or replayed — they are processed in real time on-device.

Microphone permission is required for voice sessions. You can revoke it at any time in device settings. Revoking microphone access disables voice sessions but does not affect any other feature.

By using the voice feature, you consent to your device's microphone being accessed for the duration of voice sessions. You may withdraw this consent at any time by revoking the microphone permission in your device settings.

8. Free Service

herapy is provided free of charge. We do not:

  • Charge subscription fees
  • Process payment information
  • Offer paid tiers or in-app purchases at this time

We reserve the right to introduce optional paid features in the future. If we do, we will notify you in advance and update these Terms accordingly. Any paid features would be clearly optional and subject to separate pricing terms.

9. Acceptable Use

You agree to use the Service for lawful, personal wellness purposes in accordance with these Terms.

10. Prohibited Conduct

You agree not to:

  • Use the Service if you are under 18 or impersonate another person
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Use automated tools or bots to interact with or scrape the Service
  • Introduce malware or interfere with the Service's infrastructure
  • Use the Service as a substitute for emergency mental health care in a crisis
  • Attempt to extract, record, or intercept other users' data
  • Use the Service in violation of applicable law

11. Intellectual Property

All Company Content — including the herapy name, logo, app design, voice interface, audio assets, and software — is owned by or licensed to ICI Tech Teknoloji A.Ş.

You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

Feedback you submit grants us a perpetual, royalty-free licence to use it without obligation or compensation.

12. Your Content and Data

You own the content you create in herapy — including mood entries, text session content, and memory data.

You grant us a limited licence to store and process this content solely to provide the Service to you. We do not use your content for advertising, model training, or any purpose beyond operating the Service for you.

Voice content: You do not grant us any licence over voice content because we never receive it — it stays on your device.

13. Privacy

Your use is governed by our Privacy Policy. For EEA/UK users, our GDPR Privacy Notice also applies.

Key commitments:

  • Voice is processed on-device only — we never receive audio
  • Mood and emotional data are never shared with advertising platforms
  • herapy is free — we do not collect payment data

14. Third-Party Services and Platforms

Apple App Store (iOS)

  • These Terms are between you and ICI Tech Teknoloji A.Ş. — not Apple
  • Apple has no obligation to maintain or support herapy
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you

Google Play (Android)

Google Play is not a party to these Terms.

herapy does not integrate third-party AI services, payment processors, or advertising SDKs.

15. Availability and Changes

  • We aim for continuous availability but do not guarantee uninterrupted access
  • Voice sessions work offline (on-device processing); some features may require connectivity
  • We may modify, suspend, or discontinue any feature with reasonable notice
  • We are not liable for interruptions outside our reasonable control

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, including:

  • That the Service will produce any mental health, emotional, or wellness outcome
  • That the Service is a substitute for professional mental health care
  • That voice sessions will process correctly in all device environments
  • Uninterrupted or error-free operation

17. Limitation of Liability

To the maximum extent permitted by applicable Turkish law, ICI Tech Teknoloji A.Ş. and its officers, employees, and partners shall not be liable for:

  • Any mental health outcome, emotional experience, or wellbeing result arising from use of the Service
  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, revenue, or goodwill
  • Any damages exceeding ₺500 (five hundred Turkish lira)

Nothing limits our liability for death or personal injury caused by gross negligence, fraud, or any liability that cannot be excluded under mandatory Turkish law.

18. Indemnification

You indemnify ICI Tech Teknoloji A.Ş. against claims arising from your violation of these Terms or applicable law.

19. Termination

By you

  • With account: Delete via Settings → Account → Delete Account
  • As guest: Uninstall the app — all locally stored data is permanently removed

By us

We may suspend or terminate access for breach of these Terms, legal requirements, or to protect the Service.

Effect

Your licence ends immediately. Sections 5, 6, 11, 16, 17, 18, and 20 survive termination.

20. Governing Law and Disputes

Governed by the laws of the Republic of Turkey, including the Turkish Code of Obligations and Law on Consumer Protection No. 6502.

Disputes subject to the jurisdiction of Istanbul (Çağlayan) courts, subject to mandatory EEA/UK consumer protection rights.

EEA and UK consumers retain the protections of their mandatory local consumer protection laws, which cannot be waived by these Terms.

21. Changes to These Terms

Material changes notified at least 14 days in advance. Current version at https://herapy.app/terms.

22. Miscellaneous

  • Entire agreement: These Terms and Privacy Policy constitute the entire agreement.
  • Severability: Invalid provisions severed; remainder continues.
  • Waiver: Non-enforcement is not a waiver.
  • Assignment: You may not assign without written consent; we may assign freely.
  • Force majeure: No liability for events beyond our reasonable control.
  • Language: English version prevails over translations.
